On December 20, 2013, pursuant to an order (the “Receivership Order”) of the Ontario Superior Court of Justice (Commercial List) (the “Court”), BDO Canada Limited was appointed as receiver (the “Receiver”) to exercise the powers and duties as specifically set out in the Receivership Order with respect to the assets, undertakings and properties of Fairview Nursing Home Limited (the “Debtor”) acquired for, or used in relation to a business carried on by the Debtor (collectively, the “Property”). The Receiver’s primary mandate under the Receivership Order is to market and sell the Property. The Debtor continues to be in possession and control of its business and assets and continues to be funded directly as licensee by the Ontario Ministry of Health and Long-Term Care and the Toronto Central Local Health Integration Network under existing funding arrangements.
