On January 24, 2025, BDO Canada Limited (“BDO”) was appointed as administrator (“Administrator”) pursuant to section 39 of the Law and Equity Act (“LEA”) of SVC-Mountainside ULC (“ULC”) and Shell Owners Association – Pacific (“SOAP” and together with ULC, the “Petitioners”) pursuant to an order of the Supreme Court of British Columbia (the “Court”).
The Petitioners operated and managed the Shell Mountainside Lodge. The Shell Mountainside Lodge was located at 4417 Sundial Place, Whistler, British Columbia is comprised of 42 guest rooms.
On May 8, 2025, BDO was appointed as receiver (the “Receiver”) of the Petitioners by order of the Court, pursuant to Section 39 of the LEA, immediately in respect of the 56 strata lots described in Schedule “B” to the Amended and Restated Appointment Order dated May 8, 2025 (the “A&R Appointment Order”). Commencing May 27, 2025 (the “Delayed Appointment Date”) the Receiver was appointed over all the Petitioners' present and future assets, undertakings and property (collectively, the “Property”).
The Receiver completed the sale transaction for the Shell Mountainside Lodge on May 30, 2025, as approved by the Court pursuant to an order dated May 8, 2025 (the “Approval and Vesting Order”). The Receiver has collected the sale proceeds allocated to each of SVC and SOAP and holds these funds in trust for the benefit of stakeholders with claims against each.
The distribution of sale proceeds or other asset recoveries has yet to be determined. A claims process will be conducted to identify all claimants and quantify their claims. Any distributions will be subject to Court approval and will be made to stakeholders in accordance with their respective priorities pursuant to applicable law. The claims process is currently being developed and will be communicated once available
