Conian Developments Inc. et al

Pursuant to a Second Meeting of Creditors held on March 17, 2022, BDO Canada Limited substituted McEown & Associates Ltd. as Trustee in the matter of the bankruptcies of Conian Developments Inc., Conian Developments (La Voda) Inc., Conian Developments (La Voda II) Inc., and FLII Construction Ltd. (the “Companies”).

Consolidated Distribution Order

The Notices of Disallowance were mailed and emailed by the trustees on the week of July 14, 2025. The trustees are working to understand if any appeals have been filed by any claimants and if so, will respond to these accordingly. Separately, the trustees are preparing for a dividend distribution for September/October 2025. As a dividend distribution will be issued in the form of cheques, please ensure you advise the trustees of a change of address, if any. Otherwise, the cheque will be delivered to the address on file per your proof of claim.

In its capacity as Trustee of the Conian Estate (the “Conian Trustee”), BDO recently obtained a court order consolidating the Conian Estate with the BCCE Estate for distribution purposes (the “Consolidated Distribution Order”), an entered copy will be provided for download below when available. The Consolidated Distribution Order sets out the remaining steps for administration of the bankruptcy estates of the Conian Entities and BCCE, and provides that the funds available in both the Conian Estate and the BCCE Estate will be pooled to pay creditor claims filed in both estates, on a pro rata basis. The Conian Trustee will administer the distribution process.

As set out in the Consolidated Distribution Order, the Conian Trustee and McEown & Associates Ltd., as trustee of the BCCE Estate (the “BCCE Trustee”) are in the process of adjudicating all remaining claims in the Conian Estate and the BCCE Estate. The trustees expect to finish adjudicating those remaining claims by approximately July 4, 2025. If the trustees disallow any remaining claims, each creditor whose claim was disallowed will have an opportunity to appeal that disallowance.

The trustees are working to distribute funds to creditors as soon as possible. To that end, following adjudication of remaining claims, and depending on the number and value of any disallowed claims, the Conian Trustee and the BCCE Trustee will determine whether to distribute a portion of funds to creditors on an interim basis, pending resolution of any disallowed claims that may be appealed. The Conian Trustee will continue to update creditors in that regard.

Please be advised that the hearing for the consolidation application as communicated on July 30, 2024 will reconvene in November 2024.

Also, please be advised the Involuntary Lender appeal deadline has been extended to 20 days after the Trustee's consolidation application is resolved.

Please be advised that an application will be made by BDO Canada Limited on August 12, 2024 for an order, consolidating, for distribution purposes only, the consolidated bankruptcy estates of Conian Developments Inc., Conian Developments (La Voda) Inc., and Conian Developments (La Voda II) Inc. with the bankruptcy estate of B.C. Currency Exchange Inc.

Also, please be advised the Involuntary Lender appeal deadline has been extended to August 22, 2024.

Please be advised that pursuant to an Order of the Supreme Court of British Columbia on July 20, 2023, BDO Canada Limited, as Trustee, has been authorized to conduct a Claims Process for the determination of Claims of Direct Lenders and Ordinary Creditors against the Debtors of the Companies.

Please refer to the Claims Package posted below for instructions to submit a claim to the Trustee.

A Proof of Claim must be submitted to the Trustee on or before 5:00 PM (local Vancouver time) on October 2, 2023 (the “Claims Bar Date”) to be entitled to receive any distribution in the bankruptcies.

Any lender information summary as previously submitted to BDO Canada Limited or proof of claim submitted to McEown & Associates Ltd. does not constitute as a valid submission. A new Proof of Claim in the format as prescribed in the Claims Package must be completed.

It is the preference of the Trustee to receive your claim via email for ease of receipt and notification of same.
