On February 21, 2024, BDO Canada Limited (“BDO”) was appointed by an order of the Court of King's Bench for Saskatchewan (the “Court”) as interim receiver and administrator (the “IR Administrator”) of all of the assets, undertakings, and properties of miEnergy Inc. (the “Debtor”) acquired for, or used in relation to the business carried on by the Debtor, including all proceeds thereof (the “Property”).
On May 14, 2024, BDO was discharged as IR Administrator and was appointed by Court order (the “Receivership Order”) as the Receiver of the Property, excepting the Excluded Assets (as defined in the Receivership Order). A copy of the Receivership Order can be found below.
In accordance with the Receivership Order, no Proceeding (as defined therein) against or in respect of the Debtor or the Property shall be commenced or continued except with the written consent of the Receiver or with leave of the Court and any and all Proceedings currently under way against or in respect of the Debtor or the Property are stayed and suspended pending further Order of the Court (the “Stay of Proceedings”), provided, however, that nothing in the Order shall prevent any Person (as defined therein) from commencing a proceeding regarding a claim that might otherwise become barred by statute or an existing agreement if such proceeding is not commenced before the expiration of the Stay of Proceedings.
At this time, there is no formal process in place for creditors to submit a proof of claim. Further information will be posted if, and when, such a claims process is determined to be necessary.
