On January 31, 2024, BRR Logistics Limited (“BRR”) filed a Notice of Intention to Make a Proposal (the “NOI”) pursuant to Subsection 50.4(6) of the Bankruptcy and Insolvency Act (the “BIA”) which was affirmed by the Office of the Superintendent of Bankruptcy on February 1, 2024.
On May 30, 2024, the stay of proceedings in the NOI expired and, as BRR had not filed a proposal to its creditors, the Company was deemed bankrupt on May 31, 2024 with BDO Canada Limited acting as the Licensed Insolvency Trustee.
In accordance with Section 69.3 of the BIA, all proceedings against BRR are hereby stayed. Subject to ss. (1.1) and (2) and s. 69.4 and 69.5 of the BIA, no creditor has any remedy against BRR or its assets, nor shall it commence or continue any action, execution, or other proceedings for the recovery of a claim provable in bankruptcy.
