BDO Canada Limited is the proposed Settlement Administrator pursuant to the Court-approved Orders of the Superior Court of Ontario in connection with the proposed settlement of the certified class action lawsuit Nordik Windows Inc. et al v. Aviva Insurance Company of Canada, Court File Nos. CV-20-00643386-00CP and CV-24-00728023-00CL (the “Action”).
The Court approval will authorize BDO Canada Limited (the “Settlement Administrator”) to implement and administer the settlement process arising from claims for business interruption losses suffered as a result of the COVID-19 pandemic and related government restrictions.
The class action concerns business interruption insurance claims submitted to Aviva Insurance Company of Canada (“Aviva”) under policies that included coverage for restricted access (“RA Coverage”) and/or negative publicity (“NP Coverage”) resulting from outbreaks of contagious or infectious diseases.
The parties have reached a settlement (the “Settlement”), subject to court approval, and Aviva has agreed to pay an all-inclusive amount of $150,000,000.00, inclusive of fees, disbursements, Class Proceedings Fund levy, notice and administration costs, and all other amounts (the “Settlement Amount”) in exchange for a full and final release of all claims in or relating to the Action. The Settlement is not an admission of liability on the part of Aviva but is a compromise of disputed claims.
Eligibility
The Settlement applies to businesses that:
- Purchased a valid Aviva insurance policy containing business interruption coverage;
- Held such coverage during some or all of the period from March 1, 2020 to August 31, 2021;
- Submitted notice of a business interruption insurance claim to Aviva, Class Counsel, or Epiq Class Action & Claims Solutions, Inc. on or before August 26, 2025; and
- Did not opt-out.
If you meet the above criteria and did not receive a Notice from the Settlement Administrator, please review the forms and court documents for information on how you can submit an objection, the settlement claim process, and how to make a claim under the Claim Settlement Process once court approvals have been obtained.
If you are a class member and wish to object, please complete and submit an Objection Form via the website. In order for your objection to be valid, the form must be fully completed and submitted by July 13, 2026 at 5:00 PM ET.
A Court hearing will be held to seek approval of the Settlement by the Court (the “Settlement Approval Hearing”). The Settlement Approval Hearing will take place on October 13, 2026, in person at 330 University Avenue in Toronto, or by Zoom at a link to be published on the class action website (https://aviva.claims.bdo.ca) in advance of the Settlement Approval Hearing.

Claims Process
Subject to Court approval, eligible class members may elect to participate through one of the following processes:
- Simplified Claims Process: Receive a fixed payment of $15,000, without the requirement to submit detailed financial loss information; or
- Standard Claims Process: Receive compensation based on a calculated business income loss for the 30-day indemnity period from March 18, 2020 to April 17, 2020, supported by historical tax and financial information.
Certain claims may be subject to a pro-rata adjustment depending on total approved claims and administration costs, as set out in the Settlement agreement.
Note - If you are a class member and you want to participate in the Settlement, you do not need to do anything at this time. If the Court approves the Settlement, you will be notified in writing regarding how to apply for compensation.
