On April 23, 2026, pursuant to an order (the Interim Receiver Appointment Order) of the Ontario Superior Court of Justice (the Court), BDO Canada Limited was appointed as interim receiver (the “Interim Receiver”) without security on an interim basis of all the assets, undertakings and properties of 16261311 Canada Inc. (the "Debtor").
Pursuant to the Interim Receiver Appointment Order, the Interim Receiver’s mandate is limited to monitoring, reviewing and assessing the Property on an interim basis, including obtaining access to financial information, monitoring accounts, and engaging with relevant stakeholders such as financial institutions and fuel suppliers.
Pursuant to a further order (the “Receivership Order”) of the Ontario Superior Court of Justice (the Court) dated April 30, 2026, BDO Canada Limited was appointed as receiver (the “Receiver”) without security of all the assets, undertakings and properties of 16261311 Canada Inc. (the "Debtor"). The Receivership Order and Endorsement of the Honourable Justice Fowler Byrne are attached below.
