Temporary suspension of U.S. immigrant visa processing

On January 14, 2026, the U.S. government announced that they will suspend immigrant visa processing for citizens of 75 countries, effective January 21, 2026. The suspension follows a broader directive issued in November 2025 targeting applicants deemed likely to require public assistance and linked to security and compliance concerns.

Key details

  • Interview appointments: Immigrant visa interviews are still being conducted; however, visa issuance is currently paused.
  • Exceptions: Dual nationals who apply using a passport from a country not included in the suspension are exempt.
  • Existing visas: Immigrant visas that have already been issued remain valid.
  • Non-immigrant visas: Tourist, student, and work visas are not affected by this suspension.

Employer impact, considerations, and responsibilities

Employers should expect delays for candidates requiring immigrant visas and adjust workforce planning accordingly. Offer letters tied to anticipated visa start dates may require contingency language, and alternative visa pathways may need to be explored. 

During this pause, employers must continue to:

  1. Maintain I-9 and E-Verify compliance: Continue verifying employment eligibility for all hires.
  2. Avoid discriminatory practices: Do not alter, withdraw, or delay offers based on nationality or assumptions about visa eligibility.
  3. Update offer letters and policies: Ensure employment agreements include appropriate visa-related contingencies and clearly communicate potential processing delays and alternative start arrangements.
  4. Monitor candidates’ immigration status: Track any developments in immigration processing, maintain accurate documentation, and be prepared to consider extensions or alternative visa options if necessary.
