On February 20, 2025, the Court of King’s Bench of Alberta (the “Court”) granted an order (the “IR Order”) appointing BDO Canada Limited (“BDO”) as interim receiver (the “Interim Receiver”) over the assets, undertakings, and properties of Apex Nutri-Solutions Inc. (“Apex”). Pursuant to the IR Order, the interim receivership in respect of Apex expired March 14, 2025 (unless a receiver or trustee were appointed over Apex).
Also on February 20, 2025, the Court granted an order (the “Receivership Order”) appointing BDO as receiver and manager (the “Receiver”) over the assets, undertakings, and properties of 2175551 Alberta Ltd (the “217 AB”). 217 AB is the sole shareholder of Apex.
On March 14, 2025, the Court granted a further order (the “IR Extension Order”) extending the expiry date of the IR Order to April 2, 2025.
