On February 10, 2023, Polar Window of Canada Ltd., Accurate Dorwin (2020) Inc., Glass 8 Inc., National Interiors (2021) Inc., 12986647 Canada Ltd. (O/A Allsco Windows & Doors), 12986591 Canada Ltd. (O/A Alweather Windows & Doors), Polar Holding Ltd., 10064720 Manitoba Ltd., and 12986914 Canada Ltd. (collectively the “Applicants") filed an application in the Court of King's Bench in Manitoba (the “Court") and commenced Court supervised restructuring proceedings under the Companies' Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the “CCAA").

On the same day, the Court granted an order (the “Initial Order"), which, among other things, provided for a stay of proceedings (the “Stay Period") which prohibited all parties from commencing or continuing any legal action against the Applicants, and all rights and remedies of any party against or in respect of the Applicants or their assets were stayed and suspended except with the written consent of the Applicants and the Monitor, or leave of the Court.

As a term of the Initial Order, Deloitte Restructuring Inc. was appointed as Monitor in the CCAA proceedings to oversee the operations of the Applicants during the restructuring.

On December 22, 2023, the Court granted an Order substituting BDO Canada Limited (the “Monitor”) in place of Deloitte Restructuring Inc.

Various extensions of the Stay Period were granted by the Court during the CCAA proceedings. On February 26, 2024, the stay of proceedings against the Applicants was automatically lifted.

On July 18, 2024, the Court granted an Order authorizing, amongst other relief, the termination of the CCAA proceedings and the discharge of the Monitor, upon filing of the Monitor’s Certificate substantially in the form as attached thereto.

On May 20, 2025, the Monitor’s Certificate was filed with the Court, formally discharging the Monitor and concluding the CCAA proceedings.
