C-36, as Amended ("CCAA"), pursuant to an order of the Ontario Superior Court of Justice (Commercial List). On May 8, 2009 pursuant to order of the Ontario Superior Court of Justice (the “Court”), the Gandi Group obtained protection from their creditors under the Companies’ Creditors Arrangement Act (“CCAA”). BDO Canada Limited (the “Monitor”) was named Court-appointed monitor of the Gandi Group under the CCAA proceeding. After conducting a sales process, the Monitor, with the approval of the Court, sold the Gandi Group’s assets to a third party purchaser, Agfa Corporation.

The Meeting of Creditors for the creditors of the Gandi Group has been set for February 22, 2011 at 10am Eastern Standard Time at:

The purpose of this plan will be to:
- A) consider and vote on, with or without variation, a resolution to approve the consolidated plan of compromise and arrangement of the Gandi Group under the CCAA
- B) transact such other business as may properly come before the Creditor's Meeting or any adjournment thereof.

Pursuant to an order of the Honourable Justice Cumming dated January 4, 2011 the Monitor is preparing a mailing to all unsecured creditors of the Gandi Companies to inform them of the First Meeting of Creditors to be held on February 22, 2011. The documents mailed to unsecured creditors will be available for download on this website at a later date.

On January 15, 2010 BDO Canada Limited ("BDO" or the "Monitor") was successful in overseeing the sale Gandi Innovations Limited's business assets to AGFA Graphics ("AGFA"). Subsequent to that date and pursuant to an order of Justice Morawetz of the Ontario Superior Court of Justice, the Monitor made payments to the secured creditors in respect of their outstanding obligations.
The Monitor intends to administer a claims bar process wherein a distribution will be made to the unsecured creditors. It is expected the process will begin within the next two months. Creditors will be notified of the procedures associated with filing proofs claims with the Monitor.
The funds available to the unsecured creditors are contingent upon future accounts receivable collections by AGFA. As a result, distributions to the unsecured creditors are likely to be in installments over the upcoming 6 to 18 months. The preliminary estimate of the total distribution to the unsecured creditors over that time is in the range of 25 to 40 cents on the dollar of each unsecured claim.

Today, Gandi Innovations Limited, Gandi Innovations Holdings LLC, and Gandi Innovations LLC( collectively "Gandi" or the "Respondents") was granted protection from its creditors under the Companies' Creditors Arrangement Act, R.S.C. 1985, c. C-36, as Amended ("CCAA"). The Order dated 8 May 2009 (the "Initial Order") granted by the Honourable Madam Justice Hoy of the Ontario Superior Court of Justice (Commercial List) states:
THIS COURT ORDERS that until and including May 19, 2009, or such later date as this Court may order (the "Stay Period"), no proceeding or enforcement process in any court or tribunal (each, a "Proceeding") shall be commenced or continued against or in respect of the Respondents or the Monitor, or affecting the Business or the Property, except with the written consent of the Respondents and the Monitor, or with leave of this Court, and any and all Proceedings currently under way against or in respect of the Respondents or affecting the Business or the Property are hereby stayed and suspended pending further Order of this Court.
